Ok this has actually happened to me before, The answer is, Yes i could make this clan because theres a EU Division nobody cares about that its EU, This is US so if the a US Clan makes this the same name as the EU Clan its fine.

You realize, even if a clan has disbanded, you need to ask the owner of the old disbanded clan for permission to use the name, right?
